Economy figures in casino expansion (The Buffalo News, N.Y.)

Jul. 30--NIAGARA FALLS -- Seneca Gaming Corp. executives are closely watching the downturn in the economy and the tightening credit market as they develop plans to expand the Seneca Niagara Casino & Hotel.

Brian Hansberry, Seneca Gaming chief executive, told investors during a conference call last week that the company is "constantly monitoring" a shift in the gambling industry credit market as it continues to develop its plan.

Plans to develop the Niagara Falls casino's 48-acre site have been anticipated as, in recent months, the corporation demolished a Pizza Hut, a Holiday Inn and a shuttered splash park on the property.

But despite statements earlier this year that details of the expansion would be released in January or February, no plans have been made public.

"We're rolling with the plans as we had previously stated," David Sheridan, Seneca Gaming's chief financial officer, said during the conference call. "Again, with the credit markets the way that they are -- certainly as you guys know -- it's just another factor for us to consider in monitoring and really determining what, if any, impact that's going to have on our future plans."

The 26-story glass hotel and casino currently sits on 24 acres in downtown Niagara Falls, but Seneca Gaming controls an additional 24 acres that remain undeveloped.

The hotel, completed in 2005, cost $234 million to construct and was financed through bonds.

Philip J. Pantano, Seneca Gaming spokesman, said the Seneca Niagara Casino expansion plans must be approved by the corporation's board of directors and the Seneca Nation of Indians Tribal Council before they will be made public.

But executives signaled in last week's conference call with investors that they are considering the changing economy in shaping expansion plans.

The conference call was set up to discuss a federal court ruling released earlier this month that found that the nine-acre site of the Seneca Buffalo Creek Casino is sovereign land but is not eligible for off-reservation gambling.

The ruling was limited to the Seneca's Buffalo casino.

But analysts asked several questions during the conference call on when plans for the Seneca Niagara Casino & Hotel would be released and whether the court ruling would have an impact on those proposals.

"Right now our development plans continue as we had stated prior," Hansberry said.

Plans submitted to the Empire State Development Corp. when it used its power of eminent domain to acquire property in Niagara Falls for the Seneca Nation called for constructing two additional hotel towers and adding gambling space on the 48-acre site in Niagara Falls.

Pantano has said plans for the location have evolved since then, but "you're not going to see anything less than what was proposed."

Casinos across the country have been hit by the economic downturn in recent months.

Last month, Moody's Investors Service changed its outlook for the U. S. gambling industry from stable to negative.

The report found that the U. S. gambling sector is "facing its toughest challenge" since the Sept. 11, 2001, terrorist attacks when travel was curtailed.

But the Moody's report also noted that the "huge investments in amenities at regional casinos present vacationers with compelling substitutes to Las Vegas and Atlantic City. These local markets have an added allure: convenience."

That, it said, could help develop a "permanent preference for the more convenient, nearby gaming market."

Arsonist blamed for fire at former downtown Reno casino

A fire at the former Sundowner Hotel Casino in downtown Reno was intentionally set.

That's the word from Reno Fire Department spokesman Steve Frady, who says investigators are trying to determine who set the blaze Tuesday at the building now being developed into The Belvedere luxury condominiums.

The fire, which broke out shortly before 5 p.m., produced flames 30 to 60 feet high and a thick smoke plume that could be seen around the downtown.

Frady says the blaze also caused about $120,000 in damage and prompted evacuations. He says the damage was largely confined to the building's exterior, but there was some smoke and water damage to the interior.

Meanwhile, officials are investigating whether a barbecue on a balcony caused a fire at an eight-unit Reno apartment complex early Wednesday morning.

Frady says the blaze caused about $225,000 in damage, but was confined to a single apartment in the Carlin Street structure. No injuries were reported in either fire.

Make online gambling legal: researcher

When University of Western Ontario professor June Cotte started researching online gambling, she never expected to recommend it be legalized.

"If you told me I was going to come to that conclusion at the start of research I would have laughed," said Cotte.

But when the Richard Ivey School of Business associate marketing professor dug into the subject she was shocked to find an industry that was already bringing in $12 billion to $15 billion a year.

"The horse is out of the barn. There is a huge amount of people who are already doing this," she said.

Cotte researched online gambling with colleague Kathryn Latour of the University of Nevada, interviewing 20 regular casino gamblers and 10 regular online gamblers. They found online gamblers played more frequently and aggressively.

They also found a number of troubling features of the illegal online operations that are run offshore.

For one, people who gambled online weren't as aware of their losses as they would be in a casino.

"They don't have chips dwindling in front of them, they don't have, in the case of slot machines, a can of coins that goes away," Cotte said.

The online gamblers also tended to gamble longer, integrating the gambling into their day-to-day routine.

"Some of the people . . . gamble with their kids so their kids are helping them push the buttons, learning the games," she said.

Cotte said if online gambling was legalized, as casinos are, it could be regulated to possibly reduce harmful effects.

"You could require the North American online casinos to have things like cooling off periods, where if you run out of money you don't instantaneously hit a button and upload some more. In a casino, if you run out of cash, you at least have to walk to an ATM."

There could also be requirements for popup notices to online gamblers, warning them they're crossing a threshold, such as $1,000 in losses, or that they are entering hour three of gambling.

"For some people it could just give them time to reflect that maybe they can't put in another $500," Cotte said.

"You could also have online counselling.

ANOTHER STRING FOR CANTOR’S ON-PREMISES MOBILE GAMBLING

The New York-based Cantor Fitzgerald group, already in a strong proprietary technology position in the new market of mobile gambling on licensed land casino premises, acquired a second string to its bow this week with the acquisition of Michael “Mickey” Wichinsky’s family of businesses by subsidiary Cantor Gaming.

The acquisition provides Cantor Gaming with one of Nevada’s richest portfolios of gaming content, developed over 50 years. eDeck is currently undergoing field trials at The Venetian in Las Vegas.

Professor Assails Inaccurate Claim by Congressman, Encourages Responsible Internet Gambling Regulation

Dr. Jeffrey L. Derevensky, a leading professor at McGill University, contends that Rep. Spencer Bachus (R-Ala.) incorrectly cited the university's research on gambling addiction in arguing for the continued prohibition on Internet gambling. Derevensky in fact believes that the regulation of online gambling is an opportunity to put in place safeguards to combat problem and underage gambling.

In a mark up of the Payments System Protection Act (H.R. 5767) in the House Committee on Financial Services on June 25, 2008, Rep. Bachus, citing research at McGill, claimed that one-third of college students who gambled online attempted suicide.

"This assertion, which is reportedly based upon our empirical research, is not predicated upon any factual evidence," responded Derevensky in an interview with the Safe and Secure Internet Gambling Initiative. "None of the studies conducted with adolescents or college students, to the best of my knowledge, have looked at a connection between Internet wagering and suicide attempts." Derevensky raised these same concerns in a letter sent last week to Reps. Bachus and Barney Frank (D-Mass.)

Derevensky believes there is an opportunity for Congress to better protect consumers in a regulated environment. "If Congress is serious about minimizing the threat posed by Internet gambling, it should look to create an environment where Internet gambling operators are required to put in place safeguards that protect against compulsive and underage gambling."

Last week, a study conducted jointly by the University of Western Ontario and University of Nevada, Las Vegas called for the legalization and regulation of online gambling.

"Just as legalized commercial gambling in casinos allows for governments to regulate it, so, too, could the legalization of online gambling allow for better regulation and attempts to reduce the growth of problem gamblers," said June Cotte, associate professor at the University of Western Ontario, as reported by Poker News.

Existing technology and security controls have already proven to be effective in addressing compulsive gambling. Safeguards currently available in the industry include the ability to control the amount of money wagered, set limits on amounts bet and amounts lost, restrict the duration that someone can play, identify and stop players whose gambling patterns seem out of the ordinary, and allow for consumers to be excluded from online gambling.

"It is disappointing that Rep. Bachus is using scare tactics and false claims in an attempt to justify why Congress should limit my ability to gamble online," said Jeffrey Sandman, spokesman for the Safe and Secure Internet Gambling Initiative. "We are encouraged by the academic community's support of Internet gambling regulation. They emphasize the important point that consumers will be better protected if there are safeguards put in place to combat underage and problem gambling."

The Internet Gambling Regulation and Enforcement Act of 2007 (H.R. 2046), introduced by Rep. Frank, would establish an enforcement framework for licensed gambling operators to accept bets and wagers from individuals in the U.S. It includes a number of built-in consumer protections, including safeguards against compulsive and underage gambling, money laundering, fraud and identity theft. A companion piece of legislation that would ensure the collection of taxes on regulated Internet gambling activities, the Internet Gambling Regulation and Tax Enforcement Act of 2008 (H.R. 5523) was introduced by Congressman Jim McDermott (D-WA).

Additionally, Rep. McDermott introduced last week, the Investing in our Human Resources Act (H.R.6051), which would direct new revenue generated by regulated Internet gambling activities to be spent on job training for those in the declining sectors of the economy and educational assistance for foster care youth. The bill also includes provisions to encourage responsible Internet gambling behavior and an awareness of unsafe practices, something which has been praised by problem gambling advocates.

"Though I support the dedication of resources to raise awareness about problem gambling, I encourage Congress to also provide appropriate funding for research, treatment and the prevention of problem gambling," added Derevensky.
