Tribal casinos feeling pinch

American Indian casinos continued to churn out record gaming revenues in 2007 but not at the same annual growth rate seen over the past two decades.

According to Casino City's Indian Gaming Industry Report, American Indian casinos generated $26.5 billion in gaming revenue last year, a 4.9 percent increase compared with $25.3 billion generated during 2006. The study, which is being released today, was authored by economist Alan Meister of Los Angeles-based Analysis Group.

The increase was the smallest year-over-year figure experienced by the American Indian casino industry in almost 20 years. Indian gaming revenues grew 10.2 percent in 2006, 14.6 percent in 2005, 15.3 percent in 2004 and 14.3 percent in 2003.

The sagging U.S. economy, which has been cited as the primary reason for an unprecedented decline in revenues generated by the American commercial casino market, may be affecting Indian casinos. In some states, public policies that restrict gaming expansion also factored into the growth slowdown.

Still, Meister said the figure was an increase.

"Indian gaming tends to be less impacted by the general economy," Meister said. "Indian gaming tends to be more regionalized and localized."

The industry is still seeing increases in other areas. Nongaming revenues generated by the casinos in 2007 rose 9 percent to $3.1 billion from $2.9 billion. Also, the tribal casinos employed approximately 346,000 workers in 2007, compared with approximately 343,000 workers in 2006. Salaries totaled roughly $12 billion in 2007, compared with $11.2 billion in 2006.

"It's still a healthy industry," Meister said.

American Indian tribes operated 425 gaming facilities in 28 states during 2007, according to the report.

California continued to be the nation's center for Indian gaming. The state's 60 Indian casinos accounted for more than $7.8 billion in gaming revenue during 2007, 29.4 percent of all Indian gaming revenues.

However, California's revenue growth rate was just 1.6 percent over 2006, which Meister said was attributable to both a weak economy and restrictions which slowed expansion. In February, voters allowed several tribes to increase the number of slot machines they can offer above the 1999 compact limits of 2,000 machines. In exchange, the casinos will pay increased fees to the state. However, the expansions won't have an impact until later this year and into 2009.

Meister said California's sluggish economy may be playing a role in the slowing growth rate because the state's Indian casinos primarily draw upon customers from within the state.

"Expansion has been needed but it has been delayed," Meister said.

Indian casinos in Oklahoma, by comparison, saw gaming revenues grow more than 22 percent in 2007 to almost $2.5 billion. Tribes in the state added five new casinos in 2007, mainly because of a change in state law that allowed casinos to offer Las Vegas-style slot machines.

"Oklahoma draws customers from states like Texas and Arkansas, which don't have a lot of gaming opportunities," Meister said. "That's why you see their figures climb."

Connecticut, which only has two casinos, Foxwoods and the Mohegan Sun, continued to be the nation's No. 2 Indian gaming market with more than $2.5 billion in gaming revenues. Combined, Foxwoods and Mohegan Sun have 13,469 slot machines and 691 tables games. Both casinos have plans for expansion in 2008.

Quarterly loss widens for Herbst Gaming

Financially strapped Herbst Gaming had another challenging quarter, losing $62.3 million while suffering revenue declines in both its slot machine route operations and casinos.

The Las Vegas-based company, which said in March it might be forced to file for bankruptcy, said the loss covered the quarter that ended June 30. In the same quarter a year ago, Herbst Gaming lost almost $1.4 million.

The company recently filed its quarterly earnings report with the Securities and Exchange Commission. The company did not issue a statement nor hold a conference call on the results.

Herbst Gaming's overall revenues fell 4.5 percent to $204.5 million, compared with $214.2 million in the second quarter of 2007.

Revenues from the company's 7,200-machine Nevada slot machine route operations, which have declined significantly since a voter-approved statewide smoking ban in restaurants and taverns took effect in January 2007, fell 11 percent in the quarter to $63.9 million. Casino revenues fell 8.4 percent for $120.2 million.

Herbst operates 15 casinos in Southern and Northern Nevada.

Most of the casino losses were at the company's three Primm resorts, which have seen visitation from Southern California curtailed by high gasoline prices. Herbst paid $394 million to acquire the Primm casinos from MGM Mirage in April 2007.

Herbst Gaming is privately held by brothers Ed, Tim and Troy Herbst but has publicly held debt of more than $1.146 billion.

At the end of March, Herbst Gaming told investors the company might have to seek bankruptcy protection unless it can reorganize a payment structure for its debt. Auditors said the company's troubles meeting its bond payments triggered a potential default under its credit agreement.

"We continue our evaluation of financial and strategic alternatives, which may include a recapitalization, refinancing, restructuring or reorganization of our obligations or a sale of some or all of our businesses," Herbst Gaming said in its filing with the SEC.

"We and our advisers are actively working toward such a transaction that would address the decline in our operating results and our capital structure, including our outstanding indebtedness. We cannot assure you that we will be successful in undertaking any such alternative in the near term."

FBI on Vegas mob museum bandwagon

Las Vegas -- The FBI says it has joined the backers of a new museum in Las Vegas that will be devoted to the shenanigans of organized crime in the gambling mecca's history.
A spokesman for the bureau's Vegas field office told the Las Vegas Sun Monday that the FBI will provide input to make certain the planned Las Vegas Museum of Organized Crime and Law Enforcement accurately portrays its role in fighting the mob.

FBI headquarters in Washington is pitching in by going through its archives and warehouses in search of interesting artifacts that could be added to the collection.

The project was spearheaded by Mayor Oscar Goodman, a lawyer who had his share of Mafioso clients over the years, and will likely unveil its logo and marketing plan as early as next month.

The Sun said fundraising was going along well with the help of former FBI Agent Ellen Knowlton at the helm of a non-profit group working with the city.

Gamblers want to sue Loto-Québec over VLTs

A group of gamblers has launched a lawsuit against Loto-Québec, accusing the lottery corporation of downplaying the dangers of video lottery terminals (VLTs).

The gamblers have filed for permission to launch a class-action lawsuit against the provincial corporation, seeking more than $500 million in damages to cover treatment costs for people addicted to VLTs.

Documents filed in Quebec Superior Court this week allege that Loto-Québec has not fulfilled its obligation to warn users of the risk of addiction when using VLTs. The case refers to government studies that link VLTs to pathological gambling.

The class-action lawsuit is being launched by Jean Brochu, a Quebec lawyer and recovering compulsive gambler.

Loto-Québec has stated in the past that it believes compulsive gambling is a personal health program rather than a legal issue with clearly defined liability.

Quebec started regulating VLTs in 1993. Prior to regulation, there were between 25,000 and 50,000 terminals across the province. There are now about 12,000 installed in casinos, bars and restaurants.

The application will be heard in Quebec Superior Court in September.

Woman who stole sister’s identity jailed for £40,000 benefit fraud

A woman was jailed for two years today for a £40,000 fraud in which she stole the identity of her sister living in Kenya to claim benefits.

Between 2000 and 2007, Dawn Shackleton, 46, claimed income support, housing and council tax benefits in the name of her sister Julie Menzar and her four children - as well as claiming the state handouts to which she was entitled.

After a tip-off, the Department for Work and Pensions (DWP) launched an investigation which found Shackleton's handwriting and fingerprints on various applications purporting to be from Ms Menzar, who emigrated in 1994.

At an earlier hearing Shackleton, of McDonald Road, Benwell, Newcastle, pleaded guilty to five counts of forgery and one count of making a false statement, totalling £40,000.

Shackleton and her family, who were the first in Newcastle to be evicted from a private home last year following complaints about their behaviour, have over 230 criminal convictions between them.

Jeff Taylor, representing Shackleton at Newcastle Crown Court, said that when the defendant's adult children had been in trouble with the law she had used money from the fraud "to pay their fines when she can" and "keep their heads above water".

He said that two trips she took to America were paid for legitimately by her then-partner, not using the false benefits.

"The money has not just been used to live the high life, not gambling or anything of the sort," Mr Taylor added.

"She has effectively been supporting others.

"She is sorry for what occurred and she knows it is now over."

Roger Moore, prosecuting, said that while Shackleton took over the benefits scam in 2000, someone else had begun falsely claiming in Menzar's name before then.

"Quite who was doing that is not a matter I can lay at the foot of this lady," he said.

Wearing jeans and a striped polo shirt, Shackleton was expressionless as her sentence was read out.

Judge Michael Cartlidge said: "It does appear that the defendant has a troubled family and she has been paying money to drug dealers on behalf of members of her family who owe them money."

But he said the fraud "required a certain amount of effort on her part".

"She had to keep filling in forms and administering the fraud to keep it running and it was only stopped when the department investigated and arrested her in November 2007."

He added: "I fail to see how I can fail to impose a custodial sentence today."

Speaking outside court, Roy Taylor, of the DWP's Fraud Investigation Service, said the sentence reflected the "serious matter" of attacking the benefits system.

He added: "I think it sends a message to all would-be fraudsters: be careful because we are watching them."

A spokeswoman for Northumbria police said the eviction of Shackleton and her family on August 1, 2007 followed numerous reports made to various agencies relating to anti-social behaviour and environmental health concerns.

She said: "At the time of the eviction the family had 236 convictions between them, including burglary, disorder and theft."

Bishop finds House allies vs. cyber gambling

ARCHBISHOP Oscar Cruz of Lingayen-Dagupan on Monday found allies at the House of Representatives in condemning the reported cyber gambling operations inside the Cagayan Economic Zone Authority (CEZA) that is not under the supervision of the Philippine Amusement and Gaming Corp. (Pagcor).

Both Representatives Joel Villanueva of Citizens Action Against Corruption party list and Bienvenido Abante of Manila stressed that CEZA management should not allow casino operations inside Port Irene in Sta. Ana, Cagayan, without the approval of Pagcor.

Port Irene had been in the forefront of the news in the past after American Chamber of Commerce accused CEZA of converting their Freeport as hub of used car smuggling in the Northern part of the country.

Bishop Cruz who has consistently been fighting gambling in the country claimed that it has more often led to separation among couples most of the time.

“Gambling only promotes laziness, greed and excessive love for money which is the root of all evils. I have always been against gambling, be it legal or illegal. I believe it robs the people,” Villanueva said.

For his part, Abante said he doubts that casino operations within Port Irene would be possible without the blessings of known personalities knowing fully well that it was illegal.

“I have always been consistent with my stand against gambling whether legal or illegal. But I guess illegal gambling and smuggling go hand and hand because its gains go to the pockets of only a few,” Abante pointed out.

The two lawmakers expressed their support for Sen. Jamby Madrigal’s appeal for the Senate Committee on Ways and Means to investigate casino gambling inside Port Irene that reportedly earned millions of pesos.

The lady senator was quoted as saying that CEZA officials have been promoting Port Irene over the past three years as a hub for gambling. Games, as jai alai, dog and horse racing complement the growing number of online gaming at the economic zone.

“I support any review that will expose the evils of gambling,” stressed Villanueva, the son of Christian Evangelist Bro. Eddie Villanueva.

Abante claimed that law must be implemented to set an example and send a strong message that no one is above the law.

“While economic zones are good for the country, it must be protected from people who only have greed in mind and that Filipino consumers should also enjoy quality products from these economic zones by being sold locally,” Abante added.

Economy figures in casino expansion (The Buffalo News, N.Y.)

Jul. 30--NIAGARA FALLS -- Seneca Gaming Corp. executives are closely watching the downturn in the economy and the tightening credit market as they develop plans to expand the Seneca Niagara Casino & Hotel.

Brian Hansberry, Seneca Gaming chief executive, told investors during a conference call last week that the company is "constantly monitoring" a shift in the gambling industry credit market as it continues to develop its plan.

Plans to develop the Niagara Falls casino's 48-acre site have been anticipated as, in recent months, the corporation demolished a Pizza Hut, a Holiday Inn and a shuttered splash park on the property.

But despite statements earlier this year that details of the expansion would be released in January or February, no plans have been made public.

"We're rolling with the plans as we had previously stated," David Sheridan, Seneca Gaming's chief financial officer, said during the conference call. "Again, with the credit markets the way that they are -- certainly as you guys know -- it's just another factor for us to consider in monitoring and really determining what, if any, impact that's going to have on our future plans."

The 26-story glass hotel and casino currently sits on 24 acres in downtown Niagara Falls, but Seneca Gaming controls an additional 24 acres that remain undeveloped.

The hotel, completed in 2005, cost $234 million to construct and was financed through bonds.

Philip J. Pantano, Seneca Gaming spokesman, said the Seneca Niagara Casino expansion plans must be approved by the corporation's board of directors and the Seneca Nation of Indians Tribal Council before they will be made public.

But executives signaled in last week's conference call with investors that they are considering the changing economy in shaping expansion plans.

The conference call was set up to discuss a federal court ruling released earlier this month that found that the nine-acre site of the Seneca Buffalo Creek Casino is sovereign land but is not eligible for off-reservation gambling.

The ruling was limited to the Seneca's Buffalo casino.

But analysts asked several questions during the conference call on when plans for the Seneca Niagara Casino & Hotel would be released and whether the court ruling would have an impact on those proposals.

"Right now our development plans continue as we had stated prior," Hansberry said.

Plans submitted to the Empire State Development Corp. when it used its power of eminent domain to acquire property in Niagara Falls for the Seneca Nation called for constructing two additional hotel towers and adding gambling space on the 48-acre site in Niagara Falls.

Pantano has said plans for the location have evolved since then, but "you're not going to see anything less than what was proposed."

Casinos across the country have been hit by the economic downturn in recent months.

Last month, Moody's Investors Service changed its outlook for the U. S. gambling industry from stable to negative.

The report found that the U. S. gambling sector is "facing its toughest challenge" since the Sept. 11, 2001, terrorist attacks when travel was curtailed.

But the Moody's report also noted that the "huge investments in amenities at regional casinos present vacationers with compelling substitutes to Las Vegas and Atlantic City. These local markets have an added allure: convenience."

That, it said, could help develop a "permanent preference for the more convenient, nearby gaming market."
